Purpose and Mission

The Program recognizes nail professionals and customers who contribute honest experiences, helpful education, workflow ideas, product feedback, and professional knowledge that may benefit the nail community.

The Program supports SHi®’s mission to:

SHi® values meaningful contribution over follower counts alone. Views, reach, and engagement may be considered, but they do not replace authenticity, educational value, responsible product use, professional conduct, or community impact.

Definitions

Eligibility

Unless campaign-specific terms state otherwise, participants must:

• Be at least 18 years old and legally able to enter a contract.
• Reside in a location in which participation and payment are legally permitted.
• Own or control the social-media account used to publish the content.
• Have personally purchased, received, tested, or genuinely used the featured SHi® product.
• Provide truthful contact, order, payment, and tax information when requested.
• Follow these Terms, campaign instructions, platform rules, advertising laws, and professional safety standards.
• Have a public account or otherwise provide SHi® sufficient access to review and verify the content.

Employees, contractors, immediate family members of SHi® personnel, or existing paid partners may participate only with written approval and may be subject to different disclosure and payment requirements.

SHi® may limit participation by location, product, platform, campaign, order date, purchase source, creator category, or available campaign budget.

Enrollment and Acceptance

A person may express interest in the Program through a SHi® application, designated form, email, direct message, campaign invitation, or other approved submission process.

An application, product purchase, social-media tag, or content submission does not automatically enroll the person in the Program. SHi® may approve or decline participation at its discretion, subject to applicable law.

SHi® may consider:

• Content quality and educational usefulness.
• Authenticity and professional conduct.
• Consistency and reliability.
• Product familiarity and safe use.
• Community interaction and contribution.
• Alignment with SHi®’s mission and values.
• Compliance with previous campaign obligations.

Acceptance into one campaign does not guarantee acceptance into future campaigns or advancement to a Silver, Gold, or Legacy recognition level.

Qualifying Content Requirements

To qualify for consideration, content must satisfy all applicable campaign instructions and generally must:

• Be original and created by the participating Creator.
• Feature the correct SHi® product or an approved SHi® workflow.
• Reflect the Creator’s honest experience and genuine opinion.
• Clearly show or explain how the product is used, what problem it addresses, or what the Creator learned.
• Be reasonably clear, visible, audible, and understandable.
• Include the required SHi® account tag, campaign tag, disclosure, and hashtag when instructed.
• Be published on an approved platform and remain publicly accessible for the required period.
• Follow applicable sanitation, safety, licensing, and professional-use requirements.
• Avoid false, exaggerated, unsubstantiated, or misleading claims.

Content Does Not Need to Be Perfect

SHi® values authentic professional experience over highly polished advertising. Creators do not need professional cameras, large audiences, elaborate studios, or perfect editing. However, content must be clear enough to understand and suitable for the intended platform.

Original Files

SHi® may request an original, unwatermarked, high-resolution version of Approved Content. Failure to provide a reasonably usable original file when required may affect reward eligibility.

Creator Reward Levels

Available rewards vary by campaign. The following structure may be used when specifically offered in the applicable campaign instructions:

Unless expressly stated otherwise, reward tiers are not cumulative. For example, a Creator who qualifies for a 20% reward will not also receive an additional 10% reward on the same purchase.

The total reward for a purchase will not exceed the Net Eligible Purchase Amount. Shipping, taxes, duties, gift cards, and other excluded charges are not reimbursed unless SHi® expressly agrees otherwise in writing.

Content Review and Approval

All submitted content is subject to review. SHi® may approve, decline, request revisions, or determine that content qualifies for a different reward level.

Review may consider:

• Compliance with campaign instructions.
• Educational and workflow value.
• Clarity and production usability.
• Authenticity and originality.
• Safe and responsible product use.
• Accuracy of product statements.
• Disclosure compliance.
• Verified engagement and view data.
• Professionalism and community impact.
• Availability of campaign funds and rewards.

SHi® is not required to approve content merely because it includes a tag, product mention, positive review, or qualifying number of views.

SHi® may request reasonable edits, such as correcting a product name, adding a proper disclosure, removing an unsupported claim, clarifying a safety instruction, or providing a clean original file.

A requested revision does not guarantee final approval. Only written confirmation from an authorized SHi® representative constitutes reward approval.

Deadlines and Performance Verification

Campaign-specific deadlines will control. Unless otherwise stated in writing, the following default timeframes apply:

Late submissions may be declined. SHi® may extend a deadline in writing, but is not obligated to do so.

Verification

Creators must provide accurate post links, platform analytics, screenshots, screen recordings, account insights, or other reasonable evidence requested by SHi®.

Publicly displayed view counts may be considered, but SHi® may rely on platform analytics or other verification methods when available.

Purchased views, automated activity, engagement groups, bots, manipulation, misleading screenshots, artificial traffic, or other inauthentic activity will disqualify the content and may result in removal from the Program.

Required Creator Disclosures

A Creator who may receive cash, a refund, free product, discount, commission, recognition benefit, or another incentive from SHi® must clearly disclose that relationship in the content.

The disclosure must be easy for an ordinary viewer to notice, understand, and connect to the endorsement. It must not be hidden among hashtags, placed only on a profile page, buried after “more,” or stated in vague language.

Acceptable Disclosure Examples

Clear identifiers such as #ad, #sponsored, or #paidpartner may also be required. A platform’s built-in paid-partnership tool should be used when available, but it may not replace a clear disclosure within the content itself.

Disclosure Placement

• Video: Include a visible disclosure in the video and a clear disclosure in the caption.
• Spoken endorsement: State the relationship verbally when practical.
• Image or carousel: Place the disclosure prominently in the caption and, when appropriate, on the visual itself.
• Story or temporary content: Place the disclosure directly on each relevant frame where it is easy to read.
• Livestream: Repeat the disclosure periodically so viewers joining later can understand the relationship.

Creators are responsible for complying with all applicable advertising laws and platform requirements. SHi® may require correction of an inadequate disclosure before approving a reward.

Content Ownership and Usage Rights

Creator Warranties

The Creator represents and warrants that:

• The Creator owns the content or has all permissions necessary to grant the rights described in these Terms.
• The content does not unlawfully infringe another person’s copyright, trademark, privacy, publicity, music, image, or other rights.
• Every identifiable person appearing in the content has provided any legally required permission.
• The Creator has permission to record in the salon, workplace, home, or other location shown.
• The Creator has permission to show any client, employee, model, customer information, or client service depicted.
• Any music, templates, fonts, images, footage, or sound used in the content may lawfully be used by both the Creator and SHi® for the intended purpose.

Prohibited Content and Conduct

Content or conduct may be rejected or disqualified if it includes:

• False, misleading, deceptive, or unsupported product claims.
• Claims that a cosmetic or nail product diagnoses, treats, cures, or prevents a disease or medical condition unless expressly authorized and legally permitted.
• Statements about safety, allergy prevention, chemical exposure, sanitation, or health outcomes that are unsupported or misleading.
• Unsafe product use, misuse of professional equipment, or instructions likely to cause harm.
• Failure to follow professional-use warnings or applicable licensing requirements.
• Undisclosed cash, refund, gifting, affiliate, employment, family, or other material relationships.
• Copyrighted music, video, photography, logos, artwork, or other materials used without sufficient permission.
• Client images, names, conversations, contact information, or personal details used without appropriate permission.
• Harassment, hate speech, discrimination, threats, bullying, obscenity, or defamatory statements.
• Attacks on other creators, nail professionals, customers, competitors, or brands.
• Illegal activity, dangerous conduct, or content that violates a platform’s terms.
• Fake reviews, copied testimonials, impersonation, manipulated proof, or content that was not genuinely created by the participant.
• Purchased followers, purchased views, bots, artificial engagement, or coordinated manipulation.
• Confidential SHi® information, unreleased products, supplier details, pricing information, formulas, internal conversations, or campaign information disclosed without written permission.

SHi® may require immediate correction or removal of noncompliant content. Removal does not prevent SHi® from retaining records needed for legal, payment, compliance, or fraud-prevention purposes.

Payment Conditions

Approval Required

No payment obligation arises until SHi® confirms in writing that the content and reward have been approved.

Reward Calculation

Percentage-based purchase rewards are calculated using the Net Eligible Purchase Amount associated with the approved order and qualifying product.

Unless expressly included in a campaign, rewards do not cover:

• Shipping or handling charges.
• Sales tax, duties, tariffs, or customs charges.
• Gift cards or amounts paid with gift cards.
• Tips, warranties, service fees, or payment-processing charges.
• Previously refunded, credited, disputed, or returned amounts.
• Products that were not included in the applicable campaign.

Payment Method

Rewards may be issued through the original payment method, electronic payment, check, PayPal, another approved provider, or another method selected by SHi®. The Creator must provide complete and accurate payment information.

Payment Timing

SHi® will generally process an approved Creator Reward within 30 calendar days after:

1. Final content approval;
2. Completion of performance verification;
3. Expiration of any applicable order review period;
4. Receipt of required payment and tax information; and
5. Confirmation that no return, dispute, chargeback, or violation is pending.

Financial institutions and payment providers may require additional processing time after SHi® issues payment.

Taxes

Creators are responsible for determining and paying taxes associated with Creator Rewards. SHi® may request a completed tax form, identity verification, or other legally required documentation before issuing a payment and may report payments when required by law.

Payment Limits

SHi® may establish per-post, per-order, per-household, per-Creator, monthly, annual, product, or campaign reward limits.

Unless expressly approved, the same content may not receive multiple rewards from overlapping SHi® programs.

Incorrect Information

SHi® is not responsible for payment delay or loss caused by inaccurate, incomplete, expired, or fraudulent information supplied by the Creator. Unclaimed or repeatedly rejected payments may expire after reasonable written notice, subject to applicable law.

Returns, Cancellations, Chargebacks, and Order Adjustments

A Creator Reward is intended to recognize an eligible contribution connected to a valid, completed purchase or approved campaign.

A reward may be denied, reduced, delayed, reversed, or offset if:

• The related order is canceled.
• The product is returned or refunded.
• A chargeback or payment dispute is filed.
• The order is found to be fraudulent or unauthorized.
• The Creator receives another reimbursement for the same amount.
• The order is modified so the qualifying amount is reduced.
• The Creator violates these Terms or campaign requirements.

If a Creator has already received a reward and later returns or disputes the associated order, SHi® may deduct the reward from any refund or future payment, request repayment, or suspend the Creator’s participation, subject to applicable law.

Participation in the Program does not change SHi®’s regular return, warranty, shipping, or product policies.

Creator Recognition and Status Levels

The Program may include Emerging, Silver, Gold, Legacy, or other creator levels. Recognition is based on the overall quality, consistency, professionalism, and impact of a Creator’s contribution.

Recognition is not based solely on purchases, follower counts, sales, or views. SHi® may consider:

• Educational usefulness.
• Workflow improvements shared.
• Professional consistency.
• Community service and encouragement.
• Responsible product education.
• Constructive feedback provided to SHi®.
• Original ideas that help other professionals.
• Long-term alignment with SHi® values.

Creator status, plates, features, early access, product testing, and other recognition are discretionary honors. They are not employment titles, professional licenses, certifications, endorsements of every statement made by a Creator, or guarantees of future payment.

SHi® may pause, modify, or withdraw a recognition level if a Creator engages in fraud, unsafe conduct, harassment, dishonesty, serious professional misconduct, or material violation of these Terms.

Independent Relationship

Participation does not create an employment relationship, partnership, joint venture, franchise, agency, fiduciary relationship, or exclusive representation arrangement between the Creator and SHi®.

Creators control whether and how they create content, subject to these Terms and campaign requirements. Creators are responsible for their own equipment, workspace, licensing, insurance, business expenses, taxes, and professional conduct.

A Creator may not bind SHi®, enter agreements on SHi®’s behalf, promise refunds, make warranties, represent that the Creator is a SHi® employee, or speak as an authorized company representative unless expressly authorized in writing.

Privacy and Personal Information

SHi® may collect information reasonably necessary to administer the Program, including:

• Name and contact information.
• Shipping and payment details.
• Order and transaction information.
• Social-media accounts and content links.
• Performance analytics and submission records.
• Identity or tax documentation when legally required.
• Creator level, campaign history, and compliance records.

Information will be handled in accordance with SHi®’s published Privacy Policy and applicable law. Creators should not send sensitive personal information through social-media comments or unsecured direct messages.

Creators must protect client privacy and should not disclose a client’s identity, contact information, medical information, private conversation, payment information, or service history without appropriate permission.

Suspension and Termination

Either the Creator or SHi® may end future participation in the Program at any time.

SHi® may suspend, disqualify, or terminate a Creator for reasons including:

• Violation of these Terms or campaign instructions.
• Fraud, manipulation, or false information.
• Failure to make required disclosures.
• Unsafe or misleading product claims.
• Abusive, threatening, discriminatory, or unprofessional conduct.
• Copyright, privacy, publicity, or client-consent violations.
• Repeated missed deadlines or incomplete submissions.
• Conduct reasonably likely to cause material harm to SHi® or the community.

Termination ends eligibility for future rewards. Rights already granted to SHi® for previously rewarded content will continue according to the applicable license terms.

Properly approved and earned rewards arising before termination may remain payable unless they are connected to fraud, breach, return, chargeback, or another disqualifying condition.

Program Disclaimers and Limitation of Liability

The Program is offered subject to availability. SHi® does not guarantee:

• Acceptance into the Program.
• Approval of any content.
• A specific number of views, sales, followers, or engagements.
• Selection for a campaign or recognition level.
• Continuous availability of any reward or campaign.
• That a platform will display, preserve, or distribute content.

Social-media platforms are independent services. SHi® is not responsible for platform outages, algorithm changes, account restrictions, inaccurate analytics, removed content, delayed reporting, or changes to platform policies.

To the fullest extent permitted by law, SHi® will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from participation in the Program.

To the fullest extent permitted by law, SHi®’s aggregate liability related to a specific Creator submission will not exceed the amount of the Creator Reward approved for that submission.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to every participant.

Governing Law and Disputes

These Terms will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer or other law requires otherwise.

Before filing a formal legal claim, the Creator and SHi® agree to make a good-faith effort to resolve the matter through written communication.

Unless prohibited by applicable law, legal proceedings relating to these Terms or the Program will be brought in a court of competent jurisdiction located in Collin County, Texas.

Changes to the Program or These Terms

SHi® may update these Terms, reward structures, eligibility rules, campaign requirements, recognition levels, deadlines, or payment methods from time to time.

Updated Terms will be posted with a revised effective date. Changes will apply prospectively unless a change is required for legal, safety, fraud-prevention, or platform-compliance reasons.

Material changes affecting an active approved campaign will be communicated when reasonably practical. Continued participation after updated Terms become effective constitutes acceptance of those updated Terms.

If any provision is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
